ORDINANCE NO. 1695 <br />ORDINANCE OF THE CITY COUNCIL OF THE CITY OF INDIO, CALIFORNIA, <br />AMENDING CHAPTER 159 OF TITLE XV OF THE INDIO MUNICIPAL CODE TO <br />ESTABLISH THE TEMPORARY AUTO SALES OVERLAY ZONE, RESTRICT <br />CERTAIN TEMPORARY USES DURING MAJOR MUSIC FESTIVAL EVENTS, AND <br />MAKE OTHER MINOR AMENDMENTS RELATING TO SPECIAL LAND USE <br />PERMITS AND TEMPORARY USE PERMITS <br />WHEREAS, the City of Indio initiated this Zone Text Amendment (ZTA) to amend <br />the provisions of the Indio Municipal Code regarding special land use permits and <br />temporary use permits to permit temporary auto sales on a limited basis within certain <br />designated areas of the City, restrict certain temporary uses near Major Music Festival <br />Events that could burden public resources, and to make other minor changes to the <br />process by which special land use permits and temporary use permits are issued; <br />WHEREAS, after due notice as required by law, a public hearing was held by the <br />Planning Commission of the City of Indio on April 27, 2016 to consider ZTA 16-4-67, at <br />which time the Planning Commission received oral and documentary evidence relating <br />to ZTA 16-4-67 and continued the public hearing to its special meeting on May 12, <br />2016. On May 12, 2016, the Planning Commission received further oral and <br />documentary evidence relating to ZTA 16-4-67 and after due consideration <br />recommended approval to the City Council. <br />WHEREAS, after due notice as required by law, a public hearing was held by the <br />City Council of the City of Indio on June 1St, 2016, to consider the ZTA 16-4-67. The <br />City Council received and considered oral and documentary evidence relating to ZTA <br />16-4-67, including the accompanying staff report. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF INDIO, <br />CALIFORNIA, HEREBY ORDAINS AS FOLLOWS: <br />Section 1. The City Council hereby specifically finds that all of the facts set <br />forth in the recitals of this Ordinance are true and correct. <br />Section 2. This Ordinance was assessed in accordance with the criteria <br />contained in the California Environmental Quality Act ("CEQA") and the State CEQA <br />Guidelines. The City Council finds that adoption of this Ordinance will not have a <br />significant impact on the environment and is exempt from CEQA pursuant to Section <br />15061(b)(3) of the State CEQA Guidelines. <br />Section 3. Based upon the evidence presented at the hearing, including the <br />staff report, the City Council hereby finds:
